Sears Father's Day Sweepstakes

NO PURCHASE NECESSARY. INTERNET ACCESS AND A VALID E-MAIL ADDRESS ARE REQUIRED TO ENTER. Sears Father's Day Sweepstakes ("Sweepstakes") begins at 12:01:01 AM on Eastern Standard Time ("EST") May 31, 2011 and ends at 11:59:59 PM EST on June 16, 2011 ("Entry Period").

ELIGIBILITY: Open only to legal residents of the fifty (50) United States and the District of Columbia who are 18 years of age or older at the time of entry, excluding employees of Sears Holdings Management Corporation ("Sponsor"), its respective parent companies, subsidiaries, affiliates, related companies and advertising and promotion agencies, and the families and/or household members of each of the above. Sweepstakes void where prohibited.

HOW TO ENTER: Go to the "Father's Day Sweeps" tab located at Facebook.com/sears, select one of the five (5) Prize Package Categories posted, click the "Enter" Button or the "Enter Again" Button that appears in one of the five (5) Prize Package Categories posted and then complete and submit the Official Sears Father's Day Sweepstakes Entry Form by submitting your complete name, telephone number and valid email address (hereinafter, "Gift Guy'd Entry"). The five (5) Gift Guy'd Prize Package Categories are as follows: Backyard Buff; Car Nut; DIY'er; Hipster; and The Dad Who Has Everything. Limit one (1) Gift Guy'd Entry per email address per day. Sponsor not responsible for lost, late, damaged, misdirected, illegible or incomplete entries, all of which are void. Entries become Sponsor's property and will not be acknowledged or returned. Entries must include a valid e-mail address for the Entrant. Use of automated devices are not valid for entry. Any Entry that is submitted with the use of an automated device will be void. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook.com or Twitter.com. By submitting an entry, you understand that you are submitting your information to Sears and not to Facebook.com or Twitter.com.

Sponsor and its respective parent, related, affiliated and subsidiary companies, advertising, promotion and fulfillment agencies and legal advisors and their respective officers, directors, agents, employees, and assigns (collectively, the "Released Parties") are not responsible for any problems or technical, hardware, or software malfunctions of any telephone network or telephone lines, failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this Sweepstakes, computer online systems, servers or providers, computer equipment, software, failure of any e-mail or Entry to be received by the Sponsor due to technical problems, human error or traffic congestion, unavailable network connections on the Internet or at any website, or any combination thereof, including, without limitation, any injury or damage to entrant's or any other person's computer relating to or resulting from participating in this Sweepstakes or downloading any materials in this Sweepstakes. By submitting an Entry, entrant agrees to abide by the terms of these Official Rules, and the Sears Privacy Policy.

FIVE (5) RANDOM DRAWINGS AND THEIR CORRESPONDING PRIZES: All of the Entries received will be sorted by the corresponding Gift Guy'd Prize Package Category and one (1) Winner will be randomly selected from among all Entries received for that Gift Guy'd Prize Package Category. A total of five (5) winners will be selected from among all five (5) Random Drawings. Odds of winning a Prize depend upon the number of Entries received for each Gift Guy'd Prize Package Category. The Random Drawings will be conducted by Centra Marketing & Communications, LLC. an independent judging organization whose decisions on all matters relating to this Sweepstakes are final and binding. Winners will be notified by U.S. Mail, email or telephone at Sponsor's sole discretion on or about June 17, 2011. The Sears Gift Card is subject to terms and conditions listed on the Sears Gift Card.

Hipster Prize Package: Consists of one (1) of each of the following: Viewtronic 10.1" Android WiFi G Tablet; Nikon COOLPIX L120 Black Digital Camera; and Sony 3D Blu-ray Disc Player with Wi-Fi®.

DIY'er Prize Package: Consists of one (1) of each of the following: Craftsman 255 pc Mechanics Tool Set with Tool Storage; Craftsman 19.2 volt C3 Lithium-Ion Cordless Drill-Driver; Craftsman 10 Drawer 26" Wide Red Tool Storage Combo; Craftsman DOG BONE TM SAE Wrench; and Craftsman Mechanic's 31" 2 Tray Cart.

Backyard Buff Prize Package: Consists of one (1) of each of the following: Craftsman 25cc 2 cycle Curved Shaft Weedwacker TM Gas Trimmer; Craftsman 29cc 4 cycle Straight Shaft Weedwacker Gas Trimmer; Craftsman 1700 PSI 1.4 GPM Electric Pressure Washer.

The Dad Who Has Everything Prize Package: Consists of one (1) $500 Sears Gift Card.

Total approximate retail value of all Prizes: $3,190.

PRIZE ACCEPTANCE: Limit one (1) prize per household. Prizes are subject to the Sweepstakes and all applicable federal and state laws. Prizes are not transferable. Taxes on prizes are sole responsibility of each Prize Winner. Sears will not pay for or offset any tax liability on any Prize. Any Prize Winner who receives a prize valued at $600 or more will receive a 1099 IRS tax form at year end for the retail value of prize. No prize substitutions or cash redemptions allowed except by Sponsor, who may substitute a prize of equal or greater value if advertised prize becomes unavailable. Prize Winners who receive a prize valued at $600 or more must execute and return an Affidavit of Eligibility and Liability/Publicity Release (where permissible) within 14 days of receipt of notification or Prize will be forfeited and awarded to an alternate winner in a random drawing from among all remaining Entries received that selected that Gift Guy'd Prize Package Category. Prize Winners who receive a Prize under $600 must complete and return a Prize Verification Form within 14 days of receipt of notification or that prize will be forfeited and awarded to an alternate winner in a random drawing from among all remaining e Entries received that selected that Gift Guy'd Prize Package Category. If any Prize Winner notification is returned as undeliverable, that Prize will be forfeited and that Prize will be awarded in a random drawing from among all remaining Entries that selected that Gift Guy'd Prize Package Category. Any Prize won by a minor (under applicable state law) will be awarded in minor's name to a parent or legal guardian, who will be required to sign all required documents. Sponsor will make two (2) attempts to notify potential each Prize Winner at the email address submitted at the time of entry. If a potential Prize Winner cannot be reached, if he/she is found to be ineligible, if he/she cannot or does not comply with these Official Rules, or if his/her prize or prize notification or any prize correspondence is returned as undeliverable, that potential Prize Winner may be disqualified and an alternate prize winner may be selected from the remaining Entries that selected that Gift Guy'd Prize Package Category at Sponsors' sole discretion. By accepting a Prize, each Prize Winner consents to the use of his/her name, voice, picture, likeness and video footage for advertising, publicity and promotional purposes in any medium and social media websites throughout the world in perpetuity without additional compensation except where prohibited by law. By accepting a prize, each Prize Winner must agree by signing the Affidavit of Eligibility/Prize Acceptance/Release of Liability and Publicity Release or Prize Verification Form (where permitted), that he/she is not: (i) represented under a contract (e.g., by a talent agent or manager) that would in any way limit or impair Sears' ability to display or use his/her name, likeness or any work that he/she has created in any media form; (ii) subject to an acting, modeling or any other contract that would make his/her appearance in the work a violation of any third-party rights; or (iii) under any other contractual relationship, including but not limited to any guild or union memberships, that may prevent Sears from being able to use the work or image worldwide in all media in perpetuity on a royalty-free basis, without any payment of fee obligations of any kind.

CONDITIONS OF PARTICIPATION: By participating in the Sweepstakes, each Entrant agrees to release Sponsor and its parent companies, subsidiaries, affiliates, related companies and advertising and promotion agencies, and each of their respective officers, directors, employees and agents from any and all liability, loss or damage of any kind arising out of or in connection with their participation in this Sweepstakes or with respect to awarding, receipt, possession, use and/or misuse of any prize. Sponsor is not responsible for any printing, typographical, mechanical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of the prize. Sponsor is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion via mobile phone. If for any reason, this program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes. Sponsor reserves the right to select winners from eligible entries received as of the termination date. Sponsor further reserves the right to disqualify any individual who tampers with the entry process. By entering the Sweepstakes, each entrant agrees that: (i) any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (ii) any and all claims, judgments and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event will attorneys' fees be awarded or recoverable; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and each entrant hereby knowingly and expressly waives all rights to seek, punitive, incidental or consequential damages and/or any other damages, other than actual out of pocket expenses, and/or any and all rights to have damages multiplied or otherwise increased. By entering and participating, entrant agrees to defend, indemnify and hold harmless the Sweepstakes Entities from and against any and all claims, demands, liability, damages or causes of action (however named or described) losses, costs or expenses, with respect to or arising out of or related to: (i) entrant's participation in the Sweepstakes, and (ii) entrant's acceptance, use or misuse of a prize (including, without limitation, any property loss, damage, personal injury or death caused to any person(s)). Each Prize Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this Sweepstakes or use or redemption of a prize. In the event the integrity and/or feasibility of the Sweepstakes is undermined by any event including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute, or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state, provincial or local government law, order of regulation, order of any court or jurisdiction, or other cause not reasonably within the Sponsor's control (each a "Force Majeure" event) the Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel or terminate the Sweepstakes without notice or further obligation. If the Sponsor, in its discretion, elects to abbreviate, cancel or terminate the Sweepstakes as a result of a Force Majeure event, the Sponsor reserves the right, but shall have no obligation, to award the Grand Prizes from among all valid and eligible entries received up to the time of such Force Majeure event.
